The purpose of the study is to identify and analyze the key problems faced by the nomadic peoples of Eurasia (Kazakhs, Kalmyks, Bashkirs, Buryats, etc.) in the process of integration into the legal and socio-economic space of the Russian Empire in the XVIII – first half of the XIX century.
Problem. The article is devoted to the issue of the contradictory nature of the empire's state policy towards nomadic communities. The problem of a clash of fundamentally different social and legal systems is raised – a centralized state striving for unification and control over territories and populations, and a traditional nomadic society based on customary law, tribal structure and seasonal migrations. It is examined how this clash manifested itself in legislation and administrative practice on the ground.
Methodology. The research is based on historical-legal and comparativehistorical methods. The materials include legislative acts (complete collections of laws, charters, regulations), documents from central (Senate, Ministry of Internal Affairs) and local authorities, as well as reports and correspondence from officials and the military. The sources were archival materials. A review of the historiography of imperial national policy is performed.
Novelty and results. The novelty of the research is seen in an integrated approach combining the analysis of supreme legislation and grassroots practice of its implementation. For the first time, the results of a comparative analysis of the legislative framework and administrative practice in relation to different nomadic groups over an extensive chronological period are presented in one work. A typology of the main problems of adaptation has been developed: legal status and legal proceedings (the introduction of foreign courts), the land issue (restriction of nomads and seizure of land), the tax system (transfer from natural duties to monetary fees) and the administrative structure (the introduction of steppe dumas and the hierarchy of officials from the local nobility). It is proved that the state did not act according to a single plan, but by trial and error, and its policies often generated new conflicts, despite the declared goals of enlightenment and «pacification». The author comes to the conclusion that the adaptation process was two-way: the state had to take into account local specifics, and nomadic elites actively used new institutions to strengthen their own status.
Research perspectives. This work provides the basis for further comparative studies of the models of integration of nomads into other empires (Qing, Ottoman), as well as for studying the transformation of identity and social structures of nomadic communities themselves under the influence of state policy.
