The purpose of the study is to analyze the features of the formation of the foundations of the legal status of persons assisting in the implementation of advocacy in the Russian Empire. The author analyzes historical and legal aspects, starting with the introduction of the first laws regulating advocacy, to the formation of the advocacy profile and its individual categories in the 19th century. Persons assisting in the implementation of advocacy are a group of professionals and assistants who support lawyers in their work and ensure the effective implementation of legal assistance. Such persons may include: assistant lawyers, legal consultants, researchers and analysts, clients and witnesses, secretaries and administrative staff, experts and specialists. They act as liaisons between lawyers and clients, providing the necessary support and attention to detail, which ultimately contributes to the successful resolution of legal issues.
The study highlights key stages in the development of the legal status of assistant lawyers, consultants and other persons providing legal support. The author emphasizes the importance of their role in the justice of that time. The emphasis is placed on the interaction between lawyers and government agencies, as well as on the social responsibility of the bar in the context of absolute monarchy and changes caused by social and political transformations. Particular attention is paid to the legal norms that formed the rights and obligations of these persons, which emphasizes the importance of the advocacy as an institution for the protection of citizens' rights. Finally, the article offers conclusions on the influence of the historical context on the current state of advocacy in Russia and possible ways of its further development.
The methodological basis of the study is the principles of historical science, such as interdisciplinarity and scientific objectivity, comprehensiveness, historicism, concreteness. There were also used the principles of historical science such as historicism, synchronous and diachronic approach, which allowed the author to consider the institution under study in dynamics and interaction with other forms of state activity.
The novelty of the research lies in the use of an integrated approach in studying the development of the institution under study, as well as the role of persons contributing to the implementation of advocacy in a historical context. The Institute of assistant attorneys, who contribute to the implementation of advocacy, should be considered as one of the main and independent institutions operating during the period under review.
A study of the role and place of the institute of assistants to sworn attorneys in the context of the development of the domestic system of protection of rights allows us to highlight its key function - the inclusion in the ranks of lawyers of people who meet the established criteria, who during their practice and thanks to the guiding gaze of their mentors - sworn attorneys and Councils, have managed to accumulate the necessary amount of knowledge and practical experience. Thus, the institute of assistants to sworn attorneys has established itself as a significant component in the development of the legal protection system in Russia, contributing to the formation of a professional and qualified legal community
